Five Great Reasons to Consider an On-Site Health Care Clinic By Eric Olson
With the costs of health care continually rising, most employers are seeking innovative ways to control expenses while still providing quality care for employees and their families.
One increasingly popular solution is on-site health care clinics. Essentially, an on-site health care clinic is a primary care medical office located within or near an employer's facility. It is open for a specific number of hours each week based on the number of employees at the company. Clinics can be established at companies that have as few as 100 employees or as many as 10,000 or more.
On-site clinics can offer a broad scope of services, including many of the primary care services one would expect from a family physician. As importantly, these clinics can provide primary care services and many generic medications at no cost to the employees and their dependents.
The employer is responsible for costs associated with setting up the clinic, such as building and equipping the facility, paying hourly fees for the medical professionals who staff the clinics, and paying for treatments and medications dispensed on-site. Most often, an outside company manages the on-site clinic and handles all aspects of its operation for an agreed-upon monthly management fee.
It should be noted that an on-site clinic is a supplement to, but not a replacement for, an employer's health plan. It does, however, present excellent cost-saving options for primary care as well as opportunities for switching to lower-cost health plans.

New Rulings Affecting HR
Indiana Supreme Court Lowers Bar for Indiana Discrimination Claims Recently, in Filter Specialists, Inc. v. Brooks, the Indiana Supreme Court made it easier for a plaintiff to prove a discrimination claim under the Indiana Civil Rights Law. The court did so by slightly modifying its application of the McDonnell Douglas (or indirect) method of proving a discrimination claim.
In McDonnell Douglas v. Green (1973), the United States Supreme Court handed down a three-part test by which plaintiffs in employment discrimination lawsuits commonly attempt to prove that their employers have discriminated against them. And though McDonnell Douglas was a federal court case, most states--including Indiana--also apply that test to analyze discrimination claims brought under state discrimination laws. In Filter, the Indiana Supreme Court considered the continuing validity of the McDonnell Douglas test under Indiana law and decided to slightly revise the third step.

Congratulations and Celebrations
FlashPoint congratulates Gary Cohen, who was recently named Chief Administrative Officer at our client Finish Line. In his role, Cohen will oversee the company's legal, business planning, and human resource functions.
We also recognize Pat Wachtel, CEO of Girls Incorporated of Indianapolis, for receiving a NUVO Cultural Vision Award. NUVO, an Indianapolis newsweekly, presents the annual awards in an effort to "shine a light" on individuals and organizations "who are bringing cultural innovation to our city."
Hats off to Barnes & Thornburg LLP, the law firm with which FlashPoint is affiliated. The Indianapolis Star recently commissioned a survey to identify the top workplaces in central Indiana, and Barnes & Thornburg came in second place for large companies (those with more than 250 employees). Barnes & Thornburg also just announced another expansion, this time into the Minneapolis market through acquisition of a firm based there. The Minneapolis office will be Barnes and Thornburg's tenth.
